Le <strong>market<\/strong> of <strong>real estate,<\/strong> connu pourtant pour sa r\u00e9silience y compris au plus fort de la crise, n\u2019\u00e9chappe pas \u00e0 la r\u00e8gle. Les acqu\u00e9reurs, notamment, qui <strong>restent motiv\u00e9s<\/strong> pour de nouveaux achats, doivent composer avec les difficult\u00e9s engendr\u00e9es par les <strong>diff\u00e9rentes restrictions sanitaires.<\/strong> Quelles sont leurs principales pr\u00e9occupations\u00a0? Quel est l\u2019\u00e9tat actuel du <strong>market<\/strong> of the <strong>real estate loans<\/strong>\u00a0? Nous faisons le point avec Ludovic Huzieux, co-fondateur d\u2019Art\u00e9mis courtage.<\/p>\n<p><!--more--><\/p>\n<h2>L\u2019\u00e9volution des taux et des conditions d\u2019octroi des cr\u00e9dits<\/h2>\n<p>M\u00eame si l\u2019on n\u2019en pas encore fini avec la crise sanitaire, on peut d\u2019ores et d\u00e9j\u00e0 <strong>notice<\/strong> que le <strong>market<\/strong> of the <strong>cr\u00e9dits renoue<\/strong> peu \u00e0 peu avec sa dynamique d\u2019avant la pand\u00e9mique. Nos partenaires bancaires acceptent \u00e0 nouveau, certes de mani\u00e8re progressive, d\u2019examiner de <strong>nouvelles demandes<\/strong> of <strong>real estate credit.<\/strong> L\u2019on constate en m\u00eame temps que les pr\u00e9occupations des acqu\u00e9reurs \u00e9voluent, comme en t\u00e9moigne notre derni\u00e8re \u00e9tude r\u00e9alis\u00e9e en collaboration avec OpinionWay indiquant que 74\u00a0% des Fran\u00e7ais <strong>anticipent<\/strong> une probable <strong>rise<\/strong> of the <strong>rate<\/strong> of <strong>real estate credit.<\/strong><\/p>\n<p><img decoding=\"async\" src=\"https:\/\/natureetresidencevillage.com\/wp-content\/uploads\/2021\/08\/credit-immobilier.jpg\" alt=\"Cr\u00e9dit immobilier : quelles sont les craintes des acqu\u00e9reurs ?\" \/><\/p>\n<p>Si les acqu\u00e9reurs s\u2019attendent \u00e0 ces que les <strong>\u00e9tablissements bancaires revoient<\/strong> their <strong>rate<\/strong> to the <strong>rise,<\/strong> c\u2019est parce que ces derniers l\u2019ont d\u00e9j\u00e0 fait dans un pass\u00e9 r\u00e9cent. En l\u2019occurrence, en avril\u00a02020, on a constat\u00e9 une hausse des taux de l\u2019ordre de 0.15 \u00e0 0.50\u00a0%, ind\u00e9pendamment des profils des acqu\u00e9reurs ou des <strong>types<\/strong>\u00a0of <strong>property<\/strong> pour lesquels ces derniers demandent un cr\u00e9dit \u2013 <strong>r\u00e9sidence principale, r\u00e9sidence secondaire<\/strong> ou bien locatif. Les banques expliquent leur d\u00e9cision notamment par la hausse de <strong>l\u2019obligation assimilable<\/strong> at <strong>tr\u00e9sor,<\/strong> ou OAT, \u00e0 dix ans, passant de -0.30 \u00e0 +0.10\u00a0%.<\/p>\n<p>Les Fran\u00e7ais <strong>craignent<\/strong> \u00e9galement que les <strong>conditions d\u2019obtention<\/strong> of <strong>credit<\/strong> se durcissent apr\u00e8s le confinement. Selon notre \u00e9tude, 81\u00a0% des personnes interrog\u00e9es <strong>redoutent<\/strong> en effet que les banques deviennent plus exigeantes pour accorder des pr\u00eats et 77\u00a0% d\u2019entre elles pensent que les <strong>time limit<\/strong> for the <strong>obtenir<\/strong> vont <strong>s\u2019allonger.<\/strong><\/p>\n<p>Il est important de rappeler que le <strong>durcissement<\/strong> of the <strong>conditions d\u2019octroi<\/strong> of the <strong>credits<\/strong> a commenc\u00e9 bien\u00a0 avant la crise sanitaire. Les banques ont suivi les recommandations du Haut Conseil de la stabilit\u00e9 financi\u00e8re de 2019, selon lesquelles ces <strong>establishments<\/strong> devraient faire preuve de <strong>caution<\/strong> dans l\u2019octroi des cr\u00e9dits\u00a0: ces derniers ne devraient \u00eatre accord\u00e9s qu\u2019\u00e0 des m\u00e9nages dont le <strong>debt ratio<\/strong> ne d\u00e9passe pas 33\u00a0%. Le HCSF pr\u00e9conisait en outre la <strong>fin<\/strong> of the <strong>distribution<\/strong> of <strong>loans<\/strong> s\u2019\u00e9talant sur plus de vingt-ans.<\/p>\n<p>Avec l\u2019application de ces recommandations, nombreux sont les m\u00e9nages qui se sont vu <strong>refuser<\/strong> leur demande de <strong>funding.<\/strong> D\u00e8s lors, un climat s\u2019est install\u00e9, ce qui a conduit l\u2019Association professionnelle des interm\u00e9diaires en cr\u00e9dits, ou <strong>APIC,<\/strong> de demander au HCSH un moratoire sur lesdites pr\u00e9conisations, le temps d\u2019avoir toutes les donn\u00e9es sur les acteurs du <strong>accommodation<\/strong> mais aussi d\u2019\u00e9tudier les mesures \u00e0 mettre en \u0153uvre pour <strong>faciliter<\/strong> the <strong>reprise<\/strong> of <strong>the activity<\/strong> dans la perspective d\u2019une <strong>exit<\/strong> of <strong>crisis.<\/strong><\/p>\n<h2>La baisse des taux d\u2019usure devient probl\u00e9matique dans certains dossier<\/h2>\n<p>Les banques sont tenues <strong>d\u2019appliquer<\/strong> of the <strong>taux minimum<\/strong> quand elles examinent des <strong>demandes<\/strong> of <strong>funding.<\/strong> Plusieurs param\u00e8tres entrent en ligne de compte pour l\u2019application de ces taux, notamment le taux <strong>d\u2019int\u00e9r\u00eat nominal<\/strong> mais aussi l\u2019assurance d\u00e9c\u00e8s-invalidit\u00e9, la <strong>guarantee<\/strong> of <strong>credit<\/strong> ou encore les <strong>costs<\/strong> of <strong>files<\/strong> and of <strong>brokerage.<\/strong> La Banque de France publique chaque trimestre les <strong>wear rate<\/strong> qui s\u2019imposent aux <strong>\u00e9tablissements bancaires<\/strong>\u00a0; elle porte aussi \u00e0 la connaissance du public les <strong>taux effectifs<\/strong> moyens pratiqu\u00e9s par les banques.<\/p>\n<p>On observe depuis le 1<sup>st<\/sup> avril\u00a02020 une <strong>drop<\/strong> of the <strong>taux d\u2019usure.<\/strong> Ils sont par exemple \u00e0 2.40\u00a0% pour les pr\u00eats fixes compris entre dix et vingt ans, et \u00e0 2.51\u00a0% pour les cr\u00e9dits remboursables sur vingt ou plus. Ils sont, en somme, assez faibles.<\/p>\n<p>La baisse des taux d\u2019usure est <strong>probl\u00e9matique<\/strong> dans le traitement de certains dossiers, rendant m\u00eame certains <strong>candidats in\u00e9ligibles<\/strong> malgr\u00e9 leur <strong>solvabilit\u00e9.<\/strong> Parmi les cas les plus fr\u00e9quents, on retrouve notamment les emprunteurs qui se voient appliquer un <strong>taux d\u2019assurance d\u00e9c\u00e8s-invalidit\u00e9<\/strong> particuli\u00e8rement \u00e9lev\u00e9, \u00e0 l\u2019image des seniors. C\u2019est \u00e9galement le cas des acqu\u00e9reurs qui, pour avoir d\u00e9clar\u00e9 avoir un probl\u00e8me de sant\u00e9, doivent <strong>fulfill<\/strong> of a <strong>surprime.<\/strong> Sans oublier ceux qui, en raison des risques li\u00e9s \u00e0 leurs m\u00e9tiers (pompiers, militaires\u2026) paient une <strong>assurance plus cher<\/strong> que les autres.<\/p>\n<h2>En cas de promesse de vente, les d\u00e9lais de promesse de vente continue de courir normalement<\/h2>\n<p>En pleine crise sanitaire, certaines <strong>disposition l\u00e9gislatives<\/strong> or <strong>r\u00e9glementaires<\/strong> passent presque inaper\u00e7ues quand bien m\u00eame elles auraient des incidences non <strong>n\u00e9gligeables<\/strong> au quotidien. C\u2019est le cas entre autres de l\u2019ordonnance du 15 avril\u00a02020 qui apporte une modification sur les <strong>time limit<\/strong> of <strong>r\u00e9tractation<\/strong> suite \u00e0 la signature d\u2019une <strong>promesse<\/strong> of <strong>sale.<\/strong> Le texte pr\u00e9voit notamment que lesdits d\u00e9lais continuent de courir normalement. En r\u00e9alit\u00e9, il revient sur une autre ordonnance qui, elle, rallongeait les d\u00e9lais de <strong>r\u00e9tractation<\/strong> or <strong>d\u2019instruction<\/strong> of the <strong>demandes d\u2019urbanisme.<\/strong> La nouvelle ordonnance revenait en somme au statu\u00a0quo.<\/p>","protected":false},"excerpt":{"rendered":"<p>M\u00eame si la campagne vaccinale est en pleine progression, le sentiment d\u2019inqui\u00e9tude qui impr\u00e8gne de nombreux secteurs ne s\u2019est pas pour autant dissip\u00e9.
